Texas AG Presses WNBA Over Treatment of Cunningham Fans

DALLAS, August 21, 2026: Texas Attorney General Ken Paxton has publicly weighed in on the growing controversy surrounding the treatment of fans who have rallied behind Indiana Fever star Sophie Cunningham, saying he is cautiously optimistic that the WNBA will treat those supporters fairly while making clear that he remains committed to his position on biological sex and women's sports.

Paxton's comments came after he attended the Fever's game in Dallas on Thursday with his daughter. The Texas attorney general wore a matching XX-XY Athletics shirt with her, signaling his support for Cunningham and for the broader campaign advocating biological-sex-based women's sports.

His intervention adds a prominent political voice to a controversy that has increasingly moved beyond basketball and into the broader American debate over women's sports, transgender participation and freedom of expression at sporting events.

Paxton says he is watching how fans are treated

Paxton's appearance at the Fever game was significant because Cunningham has become a prominent figure in the debate over whether biological males should compete in women's sports.

The Indiana Fever guard has publicly argued that women's sports and spaces should be protected from biological males. Her comments have generated strong support from conservative politicians and women's-sports advocates while also drawing criticism from sections of the WNBA's fan base.

Paxton's message suggests that he believes supporters of Cunningham should be allowed to express their views without being singled out simply because those views are controversial.

His comments also come after several incidents involving fans wearing clothing associated with the movement to preserve female sports.

T-shirt controversy intensified scrutiny

One of the most recent controversies involved a mother and daughter who attended a Fever game wearing XX-XY Athletics shirts. According to reports, the two fans were told by a security guard to cover their shirts or face possible ejection.

The incident generated significant criticism online and prompted the WNBA to acknowledge that the security response was inappropriate. The league said the fans should not have been threatened with removal because of the shirts.

That episode added to concerns among Cunningham supporters that fans expressing pro-women's-sports views could be treated differently from other spectators.

For Paxton, the issue appears to extend beyond one particular game. His decision to attend the Dallas matchup wearing an XX-XY shirt with his daughter was a highly visible demonstration that supporters of Cunningham's position believe they should be able to attend games and express their opinions without intimidation.

The Seattle controversy

The current dispute also follows an earlier incident at a Seattle Storm game involving teenage fans who had attended to support Cunningham.

Witnesses told Fox News Digital that some girls wearing XX-XY Athletics shirts were allegedly booed and subjected to hostile comments during the game. One witness also alleged that a Storm co-owner, Celeste Keaton, confronted the girls and called them an offensive name.

The Storm subsequently acknowledged that Keaton had made comments to two fans and apologized, saying everyone attending a Storm game should feel welcome and be treated with respect.

The WNBA later fined and suspended Keaton following the incident.

The allegations became particularly controversial because some of the supporters were teenagers. Critics argued that disagreements over transgender participation in sports should not result in adults directing hostility toward young spectators.

At the same time, the incidents have been reported primarily through accounts from witnesses and supporters, meaning individual allegations should be distinguished from conduct that has been independently established.

Cunningham has become a cultural flashpoint

The controversy surrounding Cunningham began after she publicly discussed her views on transgender athletes and said she wanted to protect young girls in sports and locker rooms.

Cunningham subsequently defended her position, saying she had received criticism but did not consider her comments hateful toward transgender people. She said she believed she could support transgender people while still opposing biological males competing against women in women's sports.

Her comments quickly attracted support from prominent figures, including conservative politicians and women's-sports advocates.

As a result, Cunningham has become more than an ordinary WNBA player in the eyes of some supporters. She has emerged as a symbol in a national debate over the future of women's athletics.

Protests have followed Cunningham around the WNBA

The controversy has increasingly appeared at WNBA games.

Supporters have organized rallies outside arenas wearing XX-XY Athletics shirts and carrying signs supporting Cunningham and women's sports. Counterprotesters have also appeared, particularly around questions concerning transgender inclusion.

A Seattle rally in July drew supporters who carried messages such as "Save Women's Sports" and "Thank You Sophie," while counterprotesters voiced opposing views.

At some games, Cunningham herself has faced loud boos from spectators.

The growing protests have created an unusual situation for the WNBA: a league traditionally focused on basketball has become a prominent arena for a national cultural debate.

WNBA faces a difficult balancing act

The league now faces the challenge of protecting both an inclusive environment and fans' ability to express lawful political and social opinions.

Professional sports venues routinely maintain rules concerning abusive behavior, offensive conduct, commercial advertising and disruptive signs. But enforcing those rules can become complicated when controversial political messages are involved.

The recent shirt controversy has highlighted the importance of applying those policies consistently.

If supporters of Cunningham are permitted to attend games wearing political or advocacy-related clothing, they may reasonably expect comparable treatment to fans expressing opposing views.

At the same time, the league has an obligation to prevent harassment and disruptive behavior directed at players, spectators or staff.

Paxton's intervention raises the political stakes

Paxton's involvement makes the controversy particularly significant in Texas.

The attorney general has frequently taken strong positions on issues involving biological sex, transgender policies and women's rights. His decision to publicly support Cunningham's fans places a senior state official directly into a dispute involving a professional sports league.

His appearance alongside his daughter also gave the issue a personal dimension. Rather than merely issuing a statement, Paxton used his attendance at the game to demonstrate support for the fans whose views he believes should be respected.

The message was directed not only at the WNBA but also at supporters who believe they have been unfairly treated at games.

A broader fight over women's sports

The Cunningham controversy is part of a much larger national argument.

Supporters of Cunningham argue that women's sports exist to provide female athletes with opportunities to compete against athletes of the same biological sex. Opponents argue that transgender athletes should not be excluded solely because of their gender identity.

The WNBA has generally emphasized inclusion and support for LGBTQ+ communities, while Cunningham's recent comments have placed her at odds with some elements of the league's broader cultural messaging.

That tension has made her increasingly prominent.

Interestingly, there are currently no known transgender athletes playing in the WNBA, meaning much of the controversy concerns the broader principle of eligibility rather than a current WNBA player competing against Cunningham.

What happens next

Paxton's comments are unlikely to end the dispute, but they demonstrate how far the controversy has expanded.

What began with one player's comments about women's sports has developed into protests outside arenas, disputes over fan clothing, questions about security enforcement and involvement by prominent political figures.

For the WNBA, the immediate challenge is maintaining an environment where fans can support or criticize Cunningham without turning games into confrontations.

For Cunningham's supporters, the issue is increasingly about whether they can publicly express their views while attending games.

And for politicians such as Paxton, the controversy provides another opportunity to argue that women's sports and freedom of expression deserve stronger protection.

The debate is therefore no longer confined to the basketball court. It has become part of the wider national argument over sports, sex, gender, political expression and the rights of athletes and fans.
